The big question is whether the judge meant to use a double negative or not. We'd all like to think so, but we've all read too many transcripts to take it for granted (although not as many read by me as you).
That illustrates one of the problems with transcripts. You don't have the benefit of the voice inflection and non-verbal communication (the judge rolling his/her eyes or whatever).
